The term extends far and includes virtually every handling of data. \u2018pseudonymisation\u2019 means the processing of personal data in such a way that the personal data can no longer be attributed to a specific data subject without the use of additional information, provided that such additional information is kept separately and is subject to technical and organisational measures to ensure that the personal data are not attributed to an identified or identifiable natural person. \u2018profiling\u2019 means any type of automated processing of personal data consisting in the use of that personal data to evaluate certain personal aspects relating to a natural person, in particular to analyse or predict aspects relating to that natural person\u2019s performance at work, economic situation, health, personal preferences, interests, reliability, behaviour, location or movements. \u2018controller\u2019 means the natural or legal person, public authority, agency or other body which, alone or jointly with others, determines the purposes and means of the processing of personal data. \u2018processor\u2019 means a natural or legal person, public authority, agency or other body which processes personal data on behalf of the controller.<\/p>\r\n<h3 id=\"dsg-general-legalbasis\">Relevant legal bases<\/h3>\r\n<p>In accordance with Art. 13 GDPR, we inform you of the legal basis for our data processing. If the legal basis is not mentioned in the data protection declaration, the following applies: The legal basis for obtaining consent is Article 6(1)(a) and Article 7 GDPR, the legal basis for processing to fulfil our services and carry out contractual measures as well as answering inquiries is Article 6(1)(b) GDPR, the legal basis for processing to fulfil our legal obligations is Article 6(1)(c) GDPR, and the legal basis for processing to safeguard our legitimate interests is Article 6(1)(f) GDPR. In the event that vital interests of the data subject or another natural person require the processing of personal data, Article 6(1)(d) GDPR serves as the legal basis.<\/p>\r\n<h3 id=\"dsg-general-securitymeasures\">Security measures<\/h3>\r\n<p>In accordance with Art. 32 GDPR, taking into account the state of the art, the implementation costs and the nature, scope, circumstances and purposes of the processing as well as the different probability and severity of the risk to the rights and freedoms of natural persons, we shall take appropriate technical and organizational measures to ensure a level of protection appropriate to the risk. Measures include, in particular, safeguarding the confidentiality, integrity and availability of data by controlling physical access to the data, as well as access, input, disclosure, safeguarding availability and segregation of the data. Furthermore, we have set up procedures that ensure the exercise of data subject rights, deletion of data and response to threats to the data. Unless expressly stated in this data protection declaration, the data stored by us will be deleted as soon as they are no longer required for their intended purpose and there are no legal retention obligations to the contrary. If the data are not deleted because they are necessary for other and legally permissible purposes, their processing will be restricted. This means that the data is blocked and not processed for other purposes. This applies, for example, to data that must be stored for commercial or tax reasons. We may also process the information on the characteristics and circumstances of persons or objects belonging to them if this is part of the subject matter of our order. This can be, for example, information about personal circumstances, mobile or immobile property. In the context of our commissioning, it may also be necessary for us to process special categories of data pursuant to Art. 9 (1) GDPR, in particular information on the health of a person. For this purpose, we obtain, if necessary, an explicit consent of the customers in accordance with Art. 6 (1) (a), Art. 7, Art. 9 (2) (a) GDPR. If necessary for the performance of the contract or by law, we disclose or transmit customer data to providers of the brokered services\/objects, insurers, reinsurers, broker pools, technical service providers, other service providers, such as cooperating associations, as well as financial service providers, credit institutions and investment companies as well as social security institutions, tax authorities, tax consultants, legal advisors, auditors, insurance ombudsmen and the institutions Federal Financial Supervisory Authority (BaFin) in the context of coverage inquiries, conclusion and settlement of contracts. We may also engage subcontractors, such as subcontractors. We obtain the consent of the customers if this is required for disclosure \/ transmission of a consent of the customers (which may be the case, for example, in the case of special categories of data pursuant to Art. 9 GDPR). The deletion of the data takes place after the expiry of legal warranty and comparable obligations, whereby the necessity of the storage of the data is checked every three years; in all other respects, the statutory retention obligations apply. In the case of statutory archiving obligations, the deletion takes place after its expiry. In particular, under German law in the insurance and financial sector, consulting protocols for 5 years, broker closing notes for 7 years and broker contracts for 5 years as well as generally 6 years for documents relevant under commercial law and 10 years for documents relevant under tax law are subject to retention. <\/span><\/p>\r\n<h3 id=\"dsg-administration\">Administration, financial accounting, office organization, contact management<\/h3>\r\n<p><span class=\"ts-muster-content\">We process data within the scope of administrative tasks as well as organization of our operations, financial accounting and compliance with legal obligations, such as archiving. In doing so, we process the same data that we process in the context of the provision of our contractual services. The processing bases are Art. 6 (1) (c) GDPR, Art. 6 (1) (f) GDPR. The processing affects customers, interested parties, business partners and website visitors. The purpose and our interest in processing lies in the administration, financial accounting, office organization, archiving of data, i.e. tasks that serve the maintenance of our business activities, the performance of our tasks and the provision of our services. The deletion of the data with regard to contractual services and contractual communication corresponds to the information mentioned in these processing activities.<\/span> We disclose or transmit data to the financial administration, consultants, such as tax consultants or auditors as well as other fee agencies and payment service providers. Furthermore, we store information about suppliers, organizers and other business partners on the basis of our business interests, e.g. for the purpose of subsequent contact. We generally store this mostly company-related data permanently.<\/p>\r\n<h3 id=\"dsg-contact\">contacting<\/h3>\r\n<p><span class=\"ts-muster-content\">When contacting us (e.g. via contact form, e-mail, telephone or via social media), the user's information is processed to process the contact request and its processing in accordance with Art. 6 (1) (b) GDPR. The information provided by the users can be stored in a customer relationship management system (\u2018CRM system\u2019) or comparable request organisation.<\/span> We delete the requests if they are no longer necessary. By subscribing to our newsletter, you agree to the reception and the procedures described.<\/span> Content of the newsletter: We send newsletters, e-mails and other electronic notifications containing promotional information (hereinafter \"newsletters\") only with the consent of the recipients or a legal permission. If, as part of a registration for the newsletter, its contents are specifically described, they are decisive for the consent of the users. In addition, our newsletters contain information about our services and us. Double opt-in and logging: The registration for our newsletter takes place in a so-called double opt-in procedure. This means that you will receive an e-mail after registration in which you will be asked to confirm your registration. This confirmation is necessary so that no one can register with foreign e-mail addresses. The registrations for the newsletter are logged in order to be able to prove the registration process in accordance with the legal requirements. This includes the storage of the registration and confirmation time, as well as the IP address. The changes to your data stored by the shipping service provider are also logged. The newsletter is sent and the success measurement associated with it is carried out on the basis of the consent of the recipients in accordance with Article 6(1)(a), Article 7 GDPR in conjunction with Section 7(2)(3) UWG or on the basis of the legal permission in accordance with Section 7(3) UWG. The logging of the registration procedure takes place on the basis of our legitimate interests in accordance with Art. 6 (1) (f) GDPR. Our interest is focused on the use of a user-friendly and secure newsletter system that serves both our business interests and meets the expectations of users and also allows us to prove consent. Cancellation\/withdrawal \u2013 You can cancel the receipt of our newsletter at any time, i.e. revoke your consent. You will find a link to cancel the newsletter at the end of each newsletter. We may store the unsubscribed e-mail addresses for up to three years on the basis of our legitimate interests before we delete them in order to be able to prove a previously given consent. The processing of this data is limited to the purpose of a possible defense against claims. An individual request for cancellation is possible at any time, provided that the former existence of consent is also confirmed.<\/p>\r\n<h3 id=\"dsg-newsletter-provider-general\">Newsletter - Mailpoet<\/h3>\r\n<p>The newsletters are sent by means of the mailing service provider MailPoet of Wysija SARL, 6 rue Dieud\u00e9, 13006, Marseille, France. The data protection regulations of the shipping service provider can be viewed here: https:\/\/www.mailpoet.com\/privacy-notice\/. The shipping service provider is used on the basis of our legitimate interests in accordance with Article 6(1)(f) GDPR and an order processing contract in accordance with the first sentence of Article 28(3) GDPR. The shipping service provider may use the data of the recipients in pseudonymous form, i.e. without assignment to a user, for the optimization or improvement of its own services, e.g. for the technical optimization of the dispatch and the presentation of the newsletter or for statistical purposes. However, the shipping service provider does not use the data of our newsletter recipients to write to them themselves or to pass on the data to third parties.<\/p>\r\n<h3 id=\"dsg-newsletter-analytics\">Newsletter - Measuring success<\/h3>\r\n<p><span class=\"ts-muster-content\">The newsletters contain a so-called \"web beacon\", i.e. a pixel-sized file that is retrieved from our server when the newsletter is opened or, if we use a shipping service provider, from its server. As part of this retrieval, technical information, such as information about the browser and your system, as well as your IP address and time of retrieval are first collected.<\/span> This information is used for the technical improvement of the services based on the technical data or the target groups and their reading behavior based on their retrieval locations (which can be determined with the help of the IP address) or access times. The statistical surveys also include determining whether the newsletters are opened, when they are opened and which links are clicked. For technical reasons, this information can be assigned to the individual newsletter recipients. However, it is neither our intention nor, if used, that of the shipping service provider to observe individual users. The evaluations serve us much more to recognize the reading habits of our users and to adapt our content to them or to send different content according to the interests of our users.<\/p>\r\n<h3 id=\"dsg-hostingprovider\">Hosting<\/h3>\r\n<p><span class=\"ts-muster-content\">The hosting services we use serve to provide the following services: Infrastructure and platform services, computing capacity, storage space and database services, security and technical maintenance services that we use for the purpose of operating this online offer.<\/span> In doing so, we or our hosting provider process inventory data, contact data, content data, contract data, usage data, meta and communication data of customers, interested parties and visitors of this online offer on the basis of our legitimate interests in an efficient and secure provision of this online offer in accordance with Art. 6 (1) (f) GDPR in conjunction with Art. 28 GDPR (conclusion of order processing contract).<\/p>\r\n<h3 id=\"dsg-logfiles\">Collection of access data and log files<\/h3>\r\n<p><span class=\"ts-muster-content\">We, or our hosting provider, collect data on each access to the server on which this service is located (so-called server log files) on the basis of our legitimate interests within the meaning of Article 6 (1) (f) GDPR. The access data includes the name of the retrieved website, file, date and time of retrieval, amount of data transferred, notification of successful retrieval, browser type and version, the user's operating system, referrer URL (the previously visited page), IP address and the requesting provider.<\/span> Log file information is stored for a maximum of 7 days for security reasons (e.g. to investigate abuse or fraud) and then deleted. Data, the further storage of which is necessary for evidentiary purposes, are excluded from deletion until the respective incident has been finally clarified.<\/p>\r\n<h3 id=\"dsg-tracking-adwords\">Google AdWords and conversion measurement<\/h3>\r\n<p><span class=\"ts-muster-content\">We use the services of \u2018Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland\u2019 on the basis of our legitimate interests (i.e. interest in the analysis, optimisation and economic operation of our online offer within the meaning of Article 6(1)(f) GDPR). (\u201cGoogle\u201d).<\/span> Google is certified under the Privacy Shield Agreement and thus offers a guarantee to comply with European data protection law (https:\/\/www.privacyshield.gov\/participant?id=a2zt000000001L5AAI&amp;status=Active). We use the Google \u2018AdWords\u2019 online marketing process to place ads on the Google advertising network (e.g., in search results, in videos, on websites, etc.) so that they are displayed to users who have a presumed interest in the ads. This allows us to display advertisements for and within our online offer in a more targeted manner in order to present users only advertisements that potentially correspond to their interests. For example, if a user is shown advertisements for products for which he or she has been interested on other online offers, this is referred to as \u2018remarketing\u2019. For these purposes, when accessing our and other websites on which the Google advertising network is active, a Google code is executed directly by Google and so-called (re)marketing tags (invisible graphics or code, also referred to as \"web beacons\") are integrated into the website. With their help, an individual cookie, i.e. a small file, is stored on the user's device (instead of cookies, comparable technologies can also be used). In this file, it is noted which websites the user visited, for which content he is interested and which offers the user has clicked, as well as technical information on the browser and operating system, referring websites, visit time and other information on the use of the online offer. We also receive an individual \u2018conversion cookie\u2019. The information collected with the help of the cookie is used by Google to create conversion statistics for us. However, we only know the total anonymous number of users who clicked on our ad and were redirected to a page with a conversion tracking tag. However, we do not receive any information that personally identifies users. The data of the users are processed pseudonymously within the framework of the Google advertising network. This means that Google does not store and process the name or e-mail address of the users, but processes the relevant data cookie-related within pseudonymous user profiles. That is, from Google's point of view, the ads are not managed and displayed for a specifically identified person, but for the cookie owner, regardless of who that cookie owner is. This does not apply if a user has expressly allowed Google to process the data without this pseudonymization. The information collected about the users is transmitted to Google and stored on Google's servers in the USA.
